Terms & Conditions

These Terms and Conditions (“Terms”) govern the access to and use of the Hospixal Hospital Information Management System (“Hospixal”, “Platform”, “Service”), owned and operated by Techxal Limited (“Techxal”, “we”, “us”, “our”).

By registering, accessing, or using Hospixal, you (“Client”, “Facility”, “User”) agree to be legally bound by these Terms. If you do not agree, you must not access or use the Platform.

1. Ownership & Intellectual Property

Hospixal, including its software, design, workflows, source code, documentation, trademarks, and all associated intellectual property, is the exclusive property of Techxal Limited.

No rights, licenses, or ownership are transferred to the Client except for a limited, revocable, non-exclusive right to use the Platform in accordance with these Terms.

2. Data Ownership & Control

All data generated, processed, stored, or transmitted through the Hospixal Platform, including but not limited to patient records, billing information, reports, logs, metadata, and analytics, is collected and controlled by Techxal.

Data export or transfer to the Client shall only occur upon written approval by Techxal and may be subject to verification, compliance checks, administrative fees, or technical limitations.

Techxal reserves the right to retain anonymized or aggregated data for operational, analytical, compliance, or improvement purposes.

3. Client Responsibilities

• Ensure all information provided during registration is accurate and lawful.
• Maintain confidentiality of login credentials.
• Comply with all applicable healthcare, data protection, and regulatory laws.
• Use the Platform strictly for lawful healthcare operations.

4. Prohibited Use

• Unauthorized access, data scraping, or system interference.
• Uploading false, misleading, or unlawful data.
• Attempting to reverse engineer or replicate the Platform.
• Using Hospixal for fraudulent, abusive, or unethical purposes.

5. Suspension & Termination

Techxal reserves the absolute right to suspend or terminate access to Hospixal at any time, without prior notice, if the Client violates these Terms, applicable laws, or poses risk to the Platform, patients, or Techxal.

Upon termination, access to data may be restricted or denied unless otherwise approved by Techxal at its sole discretion.

6. Limitation of Liability

Hospixal is provided on an “as is” and “as available” basis. Techxal shall not be liable for indirect, incidental, consequential, or punitive damages, including data loss, service interruption, or clinical decisions made using the Platform.

7. Security & Compliance

While Techxal implements industry-standard security measures, the Client acknowledges that no system is entirely risk-free and agrees to use the Platform at their own risk.

8. Modifications to Terms

Techxal may revise these Terms at any time. Continued use of Hospixal constitutes acceptance of updated Terms.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.
